Terms and Conditions – Jaguar Negro Travel

1. General Information

Jaguar Negro Travel is a tourism company based in Antigua Guatemala, Sacatepéquez, Guatemala. By booking or participating in our tours and services, the client (“traveler,” “user,” or “customer”) agrees to comply with these Terms and Conditions, which are legally binding.

2. Services Provided

Jaguar Negro Travel offers guided tours, cultural and gastronomic experiences, outdoor activities, transportation coordination, and tourism-related services in Guatemala. All tours are operated by certified guides authorized under Guatemalan regulations and in accordance with international tourism standards.

3. Bookings and Payments

  • Reservations can be made through our website, email, WhatsApp, or authorized agents.
  • To confirm a booking, full payment or a deposit (as indicated in the booking confirmation) must be received.
  • Payments can be made via credit card, bank transfer, or other authorized methods.
  • Prices are listed in USD unless otherwise specified and may vary depending on group size, season, or availability.

4. Cancellations and Refunds

  • Cancellations made at least 72 hours before the tour will be refunded, minus administrative fees (if applicable).
  • Cancellations made within 72 hours of the tour are non-refundable.
  • No refunds will be issued for no-shows, late arrivals, or unused portions of a tour.
  • If Jaguar Negro Travel cancels a tour due to weather, safety, or unforeseen circumstances, the client will be offered an alternative date or a full refund.

5. Modifications

Jaguar Negro Travel reserves the right to modify itineraries, schedules, or activities due to weather, safety concerns, road conditions, strikes, or other events beyond our control. In such cases, we will make every reasonable effort to provide a similar or better experience.

6. Responsibilities of Travelers

  • Travelers must provide accurate personal information when booking.
  • It is the traveler’s responsibility to ensure they are physically and medically fit to participate in the selected tour.
  • Travelers are expected to follow the instructions of the guide and comply with safety guidelines.
  • Travelers are responsible for their personal belongings during the tour.

7. Insurance and Liability

  • Jaguar Negro Travel strongly recommends that all travelers obtain travel and medical insurance before participating in any tour.
  • Participation in outdoor activities (such as hiking, volcano climbs, or water activities) carries inherent risks. By booking, the traveler acknowledges and accepts these risks.
  • Jaguar Negro Travel is not liable for accidents, injuries, loss, theft, or damage of personal belongings, except where negligence can be proven.

8. Minors

  • Children under 18 must be accompanied by a parent or legal guardian.
  • Some tours may have age restrictions due to safety or difficulty level.

9. Data Protection and Privacy

  • Jaguar Negro Travel collects and processes customer data in compliance with national and international data protection regulations.
  • Information is used solely for booking, communication, and service delivery.

10. Intellectual Property

All content on our website, promotional materials, and branding (texts, logos, images, itineraries) are the intellectual property of Jaguar Negro Travel. They may not be copied, distributed, or used without prior written consent.

11. Governing Law and Jurisdiction

  • These Terms and Conditions are governed by the laws of the Republic of Guatemala.
  • In case of dispute, the competent courts of Antigua Guatemala shall have jurisdiction.
  • For international travelers, these terms are also aligned with global tourism standards, ensuring fairness and transparency.

12. Acceptance of Terms

By booking or participating in a tour with Jaguar Negro Travel, the client confirms that they have read, understood, and agreed to these Terms and Conditions.
